Eligibility and Use of Services
To use our website, training app, and services, you must be at least 14 years old or of legal age in your jurisdiction. You must also possess the legal authority to enter into these terms as a binding agreement. You are not authorized to use our website, training app, and services if doing so is prohibited in your country or under any law or regulation applicable to you.

Commercial Terms
When purchasing any item on our website, you agree to read the full item listing and enter into a legally binding contract to purchase the item when you commit to buying and completing the checkout payment process. We reserve the right to change our prices for products displayed at any time and to correct pricing errors that may inadvertently occur.

You agree to indemnify and hold Team 2nd Wind LLC harmless from any demands, loss, liability, claims, or expenses made against them by any third party due to, arising out of, or in connection with your use of the website or any of the services offered on the website.

To the maximum extent permitted by applicable law, Team 2nd Wind LLC assumes no liability or responsibility for any errors, mistakes, or inaccuracies of content, personal injury or property damage, or any unauthorized access to or use of our secure servers and/or any personal information stored therein.

We reserve the right to modify these terms at any time. Your continued use of the website or our services after any such change constitutes your acceptance of the new terms.

Preference of Law and Dispute Resolution
These terms, the rights and remedies provided hereunder, and any claims and disputes related to the services shall be governed by, construed under, and enforced in all respects solely and exclusively by the internal substantive laws of The United States/Oklahoma. All such claims and disputes shall be brought in a court of competent jurisdiction in Tulsa County.

Community Users
All users that join Team 2nd Wind LLC in the community have a public profile that is visible to site visitors, and public activity will be visible to other visitors of the website. You can opt-out and exit the community anytime, and your profile will not be publicly visible.

No-Show and Late Cancellation Policy for Team 2nd Wind Classes and Appointments
At Team 2nd Wind, we appreciate your dedication to your health and fitness journey. To enhance scheduling efficiency and ensure a fair system for all, we've established the following No-Show and
Late Cancellation Policy:

Cancellation Window:
To avoid penalties, clients must cancel their reservation at least 24 hours before the scheduled class or appointment.
​
No-Show Policy:
A "No-Show" occurs when a client fails to attend a scheduled class or appointment without prior cancellation.
After two consecutive no-shows, clients will be temporarily suspended from making new reservations for 7 days.
​
Late Cancellation Penalties:
If a client cancels less than 24 hours before the scheduled class or appointment, a late cancellation fee of $15 will be charged.
In the case of a No-Show, a fee of $20 will be charged to the client's account.
​
Suspension and Probation:
After the second No-Show, the client will be suspended from making new reservations for 7 days.
Upon the end of the suspension, the client will enter a probation period where bookings require manual acceptance.
Successful completion of the probation period allows the client to resume auto-acceptance for bookings.

Appeals and Exceptions:
Clients may appeal late cancellation fees or No-Show penalties by providing valid reasons such as emergencies or unforeseen circumstances. Appeals must be submitted within 48 hours of the missed class or appointment.
Team 2nd Wind reserves the right to make exceptions to the policy based on individual circumstances.

Communication Channels:
Cancellations and appeals must be communicated through the Team 2nd Wind mobile app or website.

Reminder Notifications:
Clients will receive reminder notifications 24 hours and 1 hour before their scheduled class or appointment to reduce the likelihood of oversights.

Policy Enforcement:
Strict enforcement of the No-Show and Late Cancellation Policy aims to maintain a positive and equitable scheduling environment for all Team 2nd Wind members.

Late Arrival Policy for Team 2nd Wind Classes and Appointments
At Team 2nd Wind, we value your commitment to your fitness journey and the experience of all our members. To ensure a smooth and punctual operation of our classes and appointments, we have implemented the following Late Arrival Policy:

Arrival Time:
Clients are expected to arrive at least 10 minutes before the scheduled start time of their class or appointment.
​
Late Arrival Window:
If a client arrives within the first 5 minutes of the scheduled start time, they will be permitted to join the session.
Clients arriving more than 5 minutes late may be denied entry to the class or appointment at the discretion of the instructor.
​
Late Arrival Frequency:
Excessive late arrivals, defined as arriving late more than three times within a month, may result in penalties, such as additional workouts to make up for the missed time or a warning.
​
Communication of Lateness:
If a client anticipates being late, it is encouraged to inform the Team 2nd Wind staff or the instructor in advance, when possible.
​
Instructor Discretion:
Instructors have the discretion to manage late arrivals based on the nature of the class or appointment. Some sessions may not allow late entry due to safety or disruption concerns.

Consequences for Frequent Lateness:
Clients consistently arriving late may be subject to additional consequences, such as a mandatory consultation with a fitness advisor to address time management concerns or the potential restriction from booking for a defined period.

Appeals and Exceptions:
Clients may appeal any consequences related to late arrivals by providing valid reasons for their lateness. Appeals must be submitted within 48 hours of the session in question.
